Comedian Alex Stein yelled to Alexandria Ocasio-Cortez outside of the Capitol that she was his “favorite big booty Latina” and that he loved her.

She blocked him on Twitter, and now he’s suing.

Stein is citing a federal appeals court case against former President Donald Trump saying he violated the constitutional rights of multiple people after he blocked them on Twitter. The court ruled that Trump was acting in his official presidential capacity when he blocked people during his time as President.

Days after that ruling (in 2019), Ocasio-Cortez apologized to and settled a case with Brooklyn assemblyman Dov Hikind, who sued her for blocking him from her @AOC account in response to replies that were critical of her tweets.

AOC lifted the block on Hikind, saying he has a “First Amendment right to express his views and should not be blocked for them.”

Stein is seeking the same remedy. But the case is different, since the block came as a result of things he said in person rather than online. So it’s unclear how this will turn out.
