Montana Lawmakers Approve a State-Wide Ban on TikTok

In the latest episode of “politicians keep thumbing their noses at Gen Z and then wondering why they aren’t finding support among the youth,” lawmakers in Montana have voted to ban TikTok across the state.

The ban is the first of its kind and will set the stage of a number of court battles that could spell the future of TikTok in the US.

The Montana House voted 54-43 to send the bill to Governo Greg Gianforte’s desk to sign into law.

The governor has not directly addressed whether or when he will sign the bill.

According to the language of the bill, the ban would go into effect on January 1, 2024. It prohibits TikTok from operating within the state, and bars app stores from offering the app within the state.

Any entity found violating the law would be fined $10,000 per violation, although the mechanism of enforcement is still unclear.

The bill’s authors are already expecting a legal battle, and the ACLU has called the ban a form of censorship and a violation of free speech guaranteed under the First Amendment.

A spokesperson for TikTok said that the company will “continue to fight for TikTok users and creators in Montana whose livelihoods and First Amendment rights are threatened by this egregious government overreach.”
