ACLU Sues School District Over District Banning ‘After School Satan Club’

The American Civil Liberties Union (ACLU) is suing the Saucon Valley School District in Pennsylvania over the district’s choice to not allow the After School Satan Club to meet in district facilities.

According to the lawsuit, the district violated the First Amendment by not allowing the club to meet.

The lawsuit requests emergency and permanent injunctive relief against the district, along with compensatory and nominal damages and attorneys’ fees.

Sara Rose, deputy legal director of the ACLU of Pennsylvania, said of the lawsuit, “The Saucon Valley School District’s decision to cancel the After School Satan Club in response to public opposition sets a dangerous precedent. The First Amendment protects the expression of unpopular or controversial views from government censorship. Once the district opened up school facilities to outside use, it was bound by the First Amendment to grant equal access to all groups, regardless of their religious beliefs or viewpoints.’

The district had originally agreed to allow the club to meet, but changed their mind later. The superintendent says the club did not meet all district requirements and led to major disruptions – including a threat called into the school by a man from North Carolina who is now facing charges.

The ACLU says that once the district mentioned that threat when citing reasons to rescind their permission for the club to meet, it’s considered a “Heckler’s Veto,” which violates the First Amendment.
