Americans Have Lost Faith in the Impartiality of the Supreme Court

The year is 2023 and the political divides are stark.

The higher government institution designed to be impartial and hold the other branches in check is the Supreme Court.

But what happens when Americans no longer believe the SCOTUS is capable of impartiality?

The country is about to find out, because that’s exactly what’s happened.

Public approval of the SCOTUS’s 9 justices is at near-historic lows and a majority of Americans responded to a new poll saying they believe the justices let partisan views influence major rulings.

3/4 of Republicans approve of the SCOTUS’s recent performance. However, among Democrats, support sits at just around 13%.

More than half of the nation disapproves of how the SCOTUS is conducting business.

Much of this is due to the fact that the highly conservative-heavy SCOTUS is not reflect of the American people – who lean Democrat by the numbers. And the overturning of Roe v Wade tanked faith in the SCOTUS among even conservatives.

Just after the fall of Roe v Wade, a poll showed just 25% of Americans had confidence in the Supreme Court.

But there may be hope in the quest to retain the legitimacy of the nation’s highest courts: John Roberts.

The justice, a long-standing SCOTUS conservative, has emerged as a moderating voice, occasionally siding with liberal justices and showing Americans a path forward under a SCOTUS they no longer trust.

While liberals may not trust Roberts implicitly, 60% of Americans approved of his job in 2021 – his approval rating outpacing other high-profile officials such as the President, Vice President and other leaders.

Roberts is small comfort to an American population who feels their SCOTUS is out of sync with their values, but it’s better than no hope at all.
